TERMS OF TRADE

IN GENERAL

These terms and conditions apply to all purchases on the website www.neonful.dk, owned by Neonful APS, CVR. 42903507, Axel Kiers Vej 26, 8270 Højbjerg. By placing your order, you accept the applicable terms and conditions. Neonful therefore recommends that you read the terms and conditions carefully.

Neonful may change the terms and conditions at any time with effect for future purchases. 

PAYMENT AND PRICES

All prices at www.neonful.dk are quoted in your local currency including VAT. Before you accept your order, the final price of the order, including shipping costs.

Payment can only be made via the secured payment form on the website. Neonful accepts payment with: Visa Dankort, Visa Electron, Mastercard and MobilePay. The amount is deducted upon payment as all signs are made to order. Receipt of purchase is received by e-mail.

Your payment is processed securely and Neonful encrypts your card details using SSL (Secure Socket Layer). This means that only Shopify payments can access your payment information.

The amount is only deducted from your card when the goods are dispatched.

When you buy tailor-made products at www.neonful.dk you accept that due to the custom-made nature of the product, the full amount will be deducted immediately.

We do not charge card fees.

DELIVERY

Neonful offers delivery via various partners, currently GLS and Postnord. Delivery can be made to Denmark and the rest of the EU and is made to the address or delivery location you specified when placing your order.

The shipping costs depend on the chosen shipping method and are shown in connection with your order. Shipping to Denmark costs DKK 39-79, but we offer free shipping on orders over DKK 2,000.

All orders are dispatched after a production time of 2-3 weeks. They are then delivered after 1-2 working days, and if the order is not received within 5-7 working days, customer service should be contacted at hey@neonful.dk

The case is then investigated in our order system and, if necessary, by GLS/Postnord.

Neonful is not responsible for delays from the shipping company.

COMPLAINTS

The rules on defects in the Sale of Goods Act, including the rules on complaints, apply to the purchase of goods.

This means that you have 24 months from the date of delivery to make a complaint if the purchased goods have a defect, such as a manufacturing or material defect. You must report the defect within a reasonable time after discovering it. A complaint within 2 months of discovering the defect will always be considered valid.

When making a complaint, please write to Neonful and state as detailed as possible what the problem is.

In principle, you can choose whether you want the goods to be repaired or replaced. A refund of the purchase price, on the other hand, is only a possibility, (i) if there is a material defect, or (ii) if replacement or repair is not possible or will incur disproportionate costs for Neonful.

If the complaint is justified, Neonful will reimburse the reasonable shipping costs associated with returning the item. If your complaint is not justified, you will be responsible for the shipping costs, including Neonful's costs to return the item after investigation.

Please note that the goods must always be sent in the correct packaging. You are responsible for the goods until Neonful receives them. Therefore, save the postal receipt incl. information about shipping costs and any track & trace number.

When returning the item, please include a detailed description of the problem. 

RETURN

As a consumer, you generally have a 14-day cooling-off period when you shop with us.

To exercise your right of withdrawal, you must give us unambiguous notice of your wish to withdraw, for example by sending an email to Hey@neonful.dk .

You can also use the standard cancellation form at the bottom of these terms and conditions, but this is not obligatory.

The withdrawal period is met if you send the notification of withdrawal before the deadline has expired. You cannot withdraw from the contract by refusing to accept the goods without notifying us at the same time.

Use of the right of withdrawal within the first 14 days after delivery

Under the Consumer Contracts Act, you always have a 14-day right of withdrawal from the day you received .

If the purchase is canceled, Neonful must be notified no later than 14 days after the day you received the goods. If the withdrawal period expires on a public holiday, Saturday, Constitution Day, Christmas Eve or New Year's Eve, the withdrawal period is considered to have expired on the following weekday.

Cancellation of part of the purchase

If you have bought several items from us, you can return one or more items, even if they were bought in one order.

Please note that you will not be refunded the shipping costs if you regret part of your purchase.

No right of withdrawal on ordered goods

There is no right of withdrawal for goods made to order. This means that you cannot regret buying custom-made neon signs.

Returns and refunds

Once you have notified Neonful that you wish to exercise your right of withdrawal, we will send you a return label. The costs for returns are always borne by the customer.

The goods will then be returned to Axel Kiers Vej 26, 8270 Højbjerg. The goods must be returned no later than 14 days from the date on which you notified Neonful that you wish to cancel your purchase. The deadline is considered to have been met if the goods are sent within 14 days of notification to Neonful.

It is important to include your name and address so that Neonful can find the order in the customer register. Also mark the return as "return".

It is important that you pack the item securely when returning it as you bear the risk of the item until Neonful receives the item. If applicable, include packaging and product labels. Neonful encourages you to save shipping receipts.

When you cancel a purchase, Neonful will refund the payment to your account as soon as possible and no later than 14 days after Neonful has been notified that you wish to cancel the purchase. However, Neonful may withhold payment until the item has been returned or you have sent documentation that the item has been returned.

The refund will be made to the same means of payment you used for the purchase, unless otherwise agreed. Under no circumstances will you be charged a fee as a result of the refund.

Some goods cannot be returned by post. This applies, for example, to larger items.

The costs of returning these goods are expected to cost a maximum of: DKK 1000.

The condition of the goods when you send them back

If the goods have lost value because you have used them in a way other than what was necessary to establish their nature, characteristics and functioning, you can only get back part of the purchase price. The amount you can get back depends on the commercial value of the goods, and in some cases this may mean that you can only get back the shipping costs.

We recommend that you return the product in its original packaging.

If the original packaging is missing, this may reduce the value of the goods).

OBLIGATIONS AND RIGHTS OF THE COMPANY

The buyer always receives an order receipt when the purchase is completed. The order information is stored by Neonful for 5 years. It is not possible to access the order receipt via www.neonful.dk. If you would like a new copy of the order receipt, please send an email to hey@neonful.dk instead

Reservation

Neonful cannot be held liable in the event of failure to perform the contract due to force majeure, depending on the circumstances, such as be civil unrest, total or partial strike, in particular in the transport and/or communication sector, fire, floods or similar cases.

Neonful points out that small deviations may occur in production (max +/- 2 cm) in relation to the stated dimensions (under product description and size variants) for each individual sign.

PERSONAL INFORMATION

Neonful processes your personal data in accordance with its privacy policy.

We need the following information when you shop with us:

Name, address, telephone number and e-mail address.

We record and pass on the personal data necessary to deliver the goods to you.

The personal data is registered with Neonful ApS and stored for five years, after which the data is deleted.

We also work with a number of other companies that store and process data. These companies only process information on our behalf and are not allowed to use it for their own purposes.

We only work with data processors in the EU or in countries that can provide adequate protection for your information.

The data controller on neonful.dk is Neonful ApS.

You have the right to be informed about the data we process about you.
If you believe the information is inaccurate, you have the right to have it rectified. In some cases, we are obliged to erase your personal data if you ask us to do so. This could be, for example For example, if your data is no longer necessary in relation to the purpose for which we would use it. You can also contact us if you believe that your personal data is being processed unlawfully. You can write to us at: hey@neonful.dk.

ACCESS TO COMPLAINTS AND CHOICE OF LAW

You are always welcome to contact Neonful if you want to complain about a purchase. If we cannot reach an agreement, you can file a complaint with the Complaint Resolution Center, House of Nævnenes Hus, Toldboden 2, 8800 Viborg, if the conditions for making a complaint are met.

To be able to complain, the product or service you want to complain about must have cost a minimum of DKK 1 110 and a maximum of DKK 100 000. However, for complaints about clothing and footwear, the price must have been at least DKK 720.

The European Commission's online complaint portal can also be used when filing a complaint. This is particularly relevant for consumers living in another EU country. Complaints can be submitted here: http://ec.europa.eu/odr

The agreement between you and Neonful, including these Terms and Conditions, is governed by Danish law, subject to mandatory consumer protection rules in your country of residence.
