TERMS

The terms of trade were last updated on 5 April 2022.

GENERALLY

These conditions apply to all purchases on the website www.neonful.dk, owned by Neonful APS, CVR. 42903507, Axel Kiers Vej 26, 8270 Højbjerg. By placing your order you accept the current terms of trade. Neonful therefore recommends that you read the terms of trade carefully.

Neonful can change the conditions at any time with effect for future purchases. 

PAYMENT AND PRICES

All prices on www.neonful.dk are quoted in your local currency including VAT. Before you accept your order, the final price of the order including shipping costs will be shown.

Payment can only be made via the secured payment form on the website. Neonful receives payment with: Visa Dankort, Visa Electron, Mastercard and MobilePay. The amount is deducted on payment as all signs are made to order. Purchase receipts are received by e-mail.

Your payment is treated securely, and Neonful encrypts your card information with Secure Socket Layer (SSL). Thus, only Shopify payments access your payment information.

The amount will not be withdrawn on your card until the item is being deseeded. 

When purchasing custom made products at www.neonful.dk you agree that the full amount will be charged immediately due to the customised nature of the product.

We don't charge card fees.

DELIVERY

Neonful offers delivery through various partners, currently GLS and Postnord. Delivery can be made to Denmark and the rest of the EU and takes place to the address or place of delivery you have provided when placing your order.

The shipping costs depend on the shipping method chosen and are shown with your order. Shipping to Denmark costs 39-79 kr, however we offer free shipping on orders over 2000kr.

All orders are shipped after a production time of 2-3 weeks. Then they are delivered after 1-2 business days, and if the order is not received within 5-7 business days, customer service must be contacted at hey@neonful.dk

The matter is then investigated in our order system and if necessary at GLS/Postnord.

Neonful is not responsible for delays from the shipping company.

COMPLAINTS

The rules on the shortages of the Danish Sale of Goods Act, including the rules on complaints, apply to the purchase of goods.

That is, you have a 24-month warranty from the time of delivery if the purchased item has a defect, such as a manufacturing or material defect. You must advertise within a reasonable time after you have discovered the defect. A complaint within two months of discovering the defect will always be considered to be timely.

When advertising, please write to Neonful and state in as much detail as possible what the problem is.

As a rule, you can choose whether you want the item to be repaired or exchanged. Repayment of the purchase amount, on the other hand, is only an option, (i) in the case of a material defect, or (ii) if exchange or repair is not possible or will entail disproportionate costs for Neonful.

If the complaint is justified, Neonful will refund the reasonable shipping costs associated with sending the item back. If your complaint is not justified, you must bear shipping costs yourself, including Neonful's return costs after examination of the item.

Remember that the item must always be shipped in safe packaging. You are responsible for the item until Neonful's receipt. Therefore, save the postal receipt including information about freight costs and any track &trace number.

RIGHT OF WITHDRAWAL

As a consumer, you generally have 14 days right of withdrawal when you shop with us.  

In order to exercise your right of withdrawal, you must give us an unequivocal message that you wish to cancel the purchase, for example by sending an email to Hey@neonful.dk.

You can also use the default performance form at the bottom of these conditions, but this is not mandatory.

The cooling-off period is met if you send the notice of exercise of the right of withdrawal before the deadline. You cannot undo the purchase by refusing to receive the item without notifying us at the same time.

Exercise of the right of withdrawal within the first 14 days of delivery

According to the Consumer Contracts Act, you always have 14 days right of withdrawal valid from the day the item is received.

If the purchase is undone, Neonful must be notified within 14 days of the day you received the item. If the cooling-off period expires on a public holiday, Saturday, Constitution Day, Christmas Eve or New Year's Eve, the cooling-off period is considered to expire the following working day.

Undoing part of the purchase 

If you have purchased several items from us, you have the option to return one or more items even if they were purchased in one order. 

Please note that you will not receive a refund of the shipping costs if you cancel part of your purchase. 

No right of withdrawal on ordered goods

There is no right of withdrawal on goods made to order. This means that you cannot cancel the purchase of custom-made neon signs.

Return and refund

Once you have informed Neonful that you wish to exercise your right of withdrawal, we will send you a return label. Return costs are always covered by the customer.

The goods are then returned to Axel Kiers Vej 26, 8270 Højbjerg. The goods must be returned within 14 days of the date on which you informed Neonful that you wanted to cancel your purchase. The deadline is deemed to have been met if the goods have been dispatched within 14 days of notification to Neonful.

It is important that your name and address are attached so that Neonful has the opportunity to find the order in the customer register. The return should also be marked "return".

It is important that you pack the item securely upon return, as you bear the risk of the item until Neonful receives the item. Any packaging and product signs should be attached. Neonful encourages you to save shipping receipts.

When you cancel a purchase, Neonful will refund the payment to your account as soon as possible and no later than 14 days after Neonful receives the notification that you wish to cancel the purchase. However, neonful can withhold payment until the item is returned or you have submitted documentation that the item has been returned.

The refund will be made to the same means of payment that you used for the purchase, unless otherwise agreed. Under no circumstances will you be charged a fee as a result of the refund.

Some items cannot be returned by normal record. This applies, for example, to larger goods.  

The cost of returning these goods is expected to cost a maximum of: 1000 DKK.

The condition of the item when you return it

If the item has lost value and this is because you have used it in a different way than what was necessary to determine the nature, characteristics, and way of the item's operation, you can only get part of the purchase amount back. The amount you can get back depends on the commercial value of the item, and in some cases it can mean that you can only get the shipping costs back. 

We recommend that you return the item in the original packaging.

Missing the original packaging may result in an impairment of the item.)

OBLIGATIONS AND RIGHTS OF THE UNDERTAKING

The buyer always receives an order receipt when the purchase is made. The order's information is stored by Neonful for 5 years. It is not possible to access the order receipt via www.neonful.dk. If you want a new copy of the order receipt, please send an e-mail to hey@neonful.dk

Reservations

Neonful cannot be held liable in the event of non-performance of the contract due to force majeure, which may, as the case may be, include riots, total or partial strikes, particularly in the transport and/or communications sector, fire, floods or similar events.

Neonful points out that small deviations in production (maximum +/- 2 cm) may occur in relation to the stated target (below the product description and size variants) for each sign.

PERSONAL DATA

Neonful processes your personal data in accordance with the company's privacy policy.

We need the following information when you shop with us:

Name, address, tlf.nr. and email address. 

We record and disclose the personal data necessary to deliver the goods to you.  

The personal data is registered at Neonful ApS and stored for five years, after which the data is deleted.  

In addition, we cooperate with a number of other companies that store and process data. Companies only process information on our behalf and may not use it for their own purposes.

We only work with data processors in the EU or in countries that can provide your information with adequate protection.

The data controller of neonful.dk is Neonful ApS.  

You have the right to know what information we process about you.
If you think the information is inaccurate, you have the right to have it corrected. In some cases, we are obliged to delete your personal data if you request it. This could be, for example, if your data is no longer needed for the purpose for which we needed it. You can also contact us if you believe that your personal data is being processed in violation of the law. You can write to us at: hey@neonful.dk.

RIGHT OF APPEAL AND CHOICE OF LAW

You are always welcome to contact Neonful if you have a complaint about a purchase. If we cannot reach an agreement, you can submit a complaint to the Centre for Complaints Resolution, Nævnenes Hus, Toldboden 2, 8800 Viborg, if the conditions for making a complaint are met.

To be able to complain, the product or service you want to complain about must have cost at least DKK 1,110 and no more than DKK 100,000. However, for complaints about clothes and shoes, the price must have been at least DKK 720. There is a fee for dealing with the complaint.

The Commission's online complaints portal can also be used to lodge a complaint. This is particularly relevant for consumers resident in another EU country. Complaints can be made here: http://ec.europa.eu/odr

The agreement between you and Neonful, including these terms of trade, is governed by Danish law, unless otherwise provided by mandatory rules on consumer protection in the country where you reside.
